What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Tenant had been paying rent late from April 2020 to August 2020, and continued to pay late from September 2020 to April 2021. The Landlord filed another application for the outstanding rent arrears.
The ruling
The tenancy is terminated effective October 31, 2020. The Tenant must vacate the unit by April 30, 2021. The Tenant must pay the Landlord $4,047.38 (less any amount paid after the application was filed), $28.90 per day from April 20, 2021 until the Tenant vacates, and $186 for the application filing fee. If the Tenant does not pay the full amount by April 30, 2021, the Tenant will owe interest at 2% annually on the outstanding balance starting May 1, 2021. The Landlord's request for expedited enforcement is denied.
