What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year.

The ruling

The application was dismissed as the adjudicator found that there was no clear meeting of the minds that a landlord-tenant relationship would be formed, and the relationship between the parties was familial in nature. Therefore, the Residential Tenancies Act, 2006 does not apply.
