What happened

Tenants applied for an order determining that the Landlord failed to meet the Landlord's maintenance obligations under the Residential Tenancies Act, 2006. The Tenants alleged that the washing machine at the rental unit had been leaking, which had caused damage to the floors of the rental unit and a strange smell to emanate throughout the rental unit.

The ruling

The Landlord shall pay the Tenants a rent abatement of $1,275.00, $146.90 as reimbursement for the Tenant's reasonable expenses in identifying the maintenance issues, and $48.00 for the cost of filing the application, for a total of $1,469.90. The Landlord shall pay the Tenants the full amount owing by May 3, 2021. If the Landlord does not pay the Tenants the full amount owing by May 3, 2021, the Landlord will owe interest and the Tenants may recover the amount by deducting it from any rent that becomes due in the future.
