What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Tenant did not dispute that she had not paid rent since October 2018, but disputed the amount of rent arrears. The Tenant claimed there was a prior payment plan with the Landlord, but the Landlord testified that the payment plan was proposed but never issued by the Board.
The ruling
The tenancy is terminated effective November 20, 2020. The Tenant must pay the Landlord $26,006.27 in rent arrears and compensation, plus $36.73 per day starting November 10, 2020 until the Tenant vacates. The Tenant can void the eviction order by paying $28,047.00 on or before November 20, 2020.
