What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit prior to the hearing date.
The ruling
The tenancy is terminated unless the Tenant's estate pays the rent arrears and costs by September 30, 2022. If the payment is not made, the estate must remove the Tenant's property from the rental unit by October 31, 2022 or the Landlord may dispose of it. The Landlord is entitled to compensation for the Tenant's continued occupation of the unit.
