Dispute
Termination of Tenancy
Landlord
G., C.K.
Tenant
M.A.

What happened

The landlords, GK and CM K, applied for an order to determine whether the Residential Tenancies Act, 2006 applies to their dispute with M A. The landlords hired M A to conduct repairs to their rental property, but M A moved into the property and claimed he was a tenant. The landlords denied that a tenancy agreement was formed.

The ruling

The Residential Tenancies Act, 2006 does not apply to the dispute between the landlords and M A. M A is not a tenant, and the landlords did not consent to his occupation of the property.
