What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The parties reached an agreement to terminate the tenancy as of December 31, 2023, and the Tenant does not have the option to void the eviction order by paying the outstanding rent arrears.

The ruling

The tenancy between the Landlord and the Tenant is terminated as of December 31, 2023. The Tenant shall pay $1,500.00 to the Landlord for rent arrears up to January 31, 2023, in monthly installments of $125.00 starting February 1, 2023. The Tenant shall also pay the new rent on time and in full as it comes due from February 1, 2023, to December 1, 2023. The Landlord agrees not to serve a new N4 notice of termination provided the Tenant does not breach this order.
