What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants because the Tenants failed to meet a condition specified in a previous order issued by the Board. The Tenants filed a motion to set aside the order.
The ruling
Order TNL-33737-21, issued on August 13, 2021, is set aside. The Landlord's application under section 78 of the Act is dismissed. Order TNL-26925-20, issued on May 3, 2021, remains in effect and is modified as follows: The Tenant shall pay to the Landlord the lawful rent in full and on time for each consecutive month commencing November 2021 and continuing through October 2022. If the Tenant fails to make the payments in full and on time, the entire balance will become due and payable, and the Landlord can apply for an order terminating the tenancy and evicting the Tenant.
