What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants were not present at the hearing.

The ruling

The tenancy is terminated effective September 6, 2021. The Tenants must pay the Landlord $1,343.54, which includes rent arrears, compensation, and NSF cheque charges, less the rent deposit and interest. The Tenants must also pay $41.18 per day for each day of occupation starting August 27, 2021 until they move out. The Tenants can void the order and continue the tenancy by paying $1,666.76 by August 31, 2021 or $2,919.21 by September 6, 2021.
