What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not vacated the rental unit as of the hearing date.

The ruling

The tenancy is terminated effective January 24, 2022, unless the Tenants pay $3,125.48 to the Landlord or to the Board in trust by that date to void the eviction order. If the Tenants do not make this payment, they must move out by January 24, 2022, and pay the Landlord $834.30 plus $46.46 per day for use of the unit until they move out. The Tenants must also pay the $186 application fee.
