What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Landlord has entered into an agreement of purchase and sale of the rental unit and the purchaser requires possession of the rental unit for the purpose of residential occupation. The Landlord also claimed compensation for each day the Tenant remained in the unit after the termination date.

The ruling

The tenancy is terminated effective March 3, 2021. The Tenant must move out of the rental unit on or before March 3, 2021. The Tenant shall pay the Landlord $5,623.20 for the use of the unit from March 1, 2020 to February 23, 2021, and $15.62 per day for compensation for the use of the unit from February 24, 2021 to the date the Tenant moves out of the unit. The Tenant shall also pay the Landlord $190.00 for the cost of filing the application. If the Tenant does not pay the full amount owing on or before March 3, 2021, the Tenant will start to owe interest at 2.00% annually on the balance outstanding.
