What happened

Landlord applied for an order to terminate the tenancy and evict Tenants because the Landlord requires possession of the rental unit for the purpose of residential occupation. Tenants disputed the good faith of the Landlord's intention to occupy the unit.

The ruling

The Board found that the Landlord served the N12 notice in good faith and requires the unit for personal use. The tenancy is terminated effective July 31, 2017, giving Tenants an additional month to vacate. If Tenants do not move out by July 31, 2017, they must pay $32.32 per day for use of the unit until they vacate.
