What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had vacated the rental unit prior to the hearing date.

The ruling

The tenancy is terminated effective October 3, 2020. The tenant must pay the landlord $4,134.38 in rent arrears and application costs, plus $17.79 per day in compensation starting September 23, 2020 until the tenant vacates. If the tenant does not pay the full amount by October 3, 2020, the landlord may file the order for enforcement and the tenant will owe interest. The tenant can void the order by paying $4,474 by September 30, 2020 or $5,015 by October 3, 2020.
