What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the tenant did not void by paying the arrears.
The ruling
The tenancy is terminated effective November 28, 2020. The Tenant must move out by that date. The Landlord owes the Tenant $874.89 for the rent deposit and interest, but the Landlord can offset $30.41 per day for compensation starting November 18, 2020 and $175 for the application fee. If the Tenant pays $637 by November 28, 2020, the eviction order will be void and the tenancy will continue.
