What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Tenant claimed there was a flood in the rental unit that made it unfit for habitation, but provided no disclosure prior to the hearing as required. The Tenant's inconsistent testimony made it challenging to find that she was not reasonably able to participate at the hearing.

The request to review order LTB-L-015822-22 issued on October 24, 2022 is denied. The order is confirmed and remains unchanged. The interim order issued on November 3, 2022 is cancelled and the stay of order LTB-L-015822-22 is lifted immediately.
