What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not vacated the rental unit as of the hearing date.

The ruling

The tenancy is terminated effective September 15, 2020. The tenant must pay the landlord $311.03, which includes rent arrears up to September 4, 2020 less the rent deposit and interest, as well as $175 in application fees. The tenant must also pay $40.63 per day in compensation starting September 5, 2020 until they vacate the unit. If the tenant pays $2,735.65 on or before September 15, 2020, the eviction order will be void and the tenancy will continue.
