What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not paid the total rent they were required to pay from May 1, 2019 to November 30, 2020.
The ruling
The tenancy was terminated effective November 20, 2020. The tenants are ordered to pay $21,692.61 to the landlord, which includes rent arrears up to the termination date, compensation for use of the unit, and the cost of filing the application, minus the rent deposit and interest on the deposit. If the tenants pay $24,175 on or before November 20, 2020, the eviction order will be void and the tenancy will continue.
