What happened

Landlord applied for an order to terminate the tenancy and evict Tenant because the Tenant, another occupant of the rental unit or a person the Tenant permitted in the residential complex has seriously impaired the safety of any person.

The ruling

The Landlord's application was dismissed because the Landlord served the N7 Notice of Termination only nine days prior to the termination date provided on the notice of termination rather than at least ten days prior to the termination date, in contravention of subsection 66(2) of the Residential Tenancies Act, 2006.
