What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the full rent for the period from January 1, 2021 to December 31, 2021.
The ruling
The tenancy is terminated effective January 14, 2022. The Tenant must pay the Landlord $521.77, plus $4.93 per day starting December 21, 2021 until the Tenant vacates the unit. If the Tenant does not pay the full amount by January 14, 2022, the Landlord may file the order with the Court Enforcement Office to enforce the eviction. The Tenant has the right to void the order and continue the tenancy by paying $576 by December 31, 2021 or $726 by January 14, 2022.
