What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent and persistent late payment of rent. The Landlord served a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears.

The ruling

The tenancy is terminated effective May 1, 2021 unless the Tenant pays $24,190 to void the eviction order. If the Tenant does not make this payment, the Landlord may file the order with the Sheriff to enforce the eviction. If the Tenant is able to void the L1 Application, the L2 Application for persistent late payment is denied subject to the Tenant paying rent on time for 12 months.
