What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had promised to vacate the rental unit on September 10, 2020 but remained in possession.
The ruling
The tenancy is terminated effective April 5, 2021. The Tenants must pay the Landlord $14,044.36, which includes rent arrears, compensation, and the application fee, less the rent deposit and interest owed to the Tenants. The Tenants are also ordered to pay $70.68 per day for each day of occupation starting March 26, 2021 until they vacate the unit. The Tenants can void the eviction order by paying $16,849 by March 31, 2021 or $18,999 by April 5, 2021.
