What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The Landlord's application for eviction of the Tenant is denied on the condition that: (a) The Tenant shall make payments of $304 per month for 17 months starting June 15, 2021, and a final payment of $313.31 on or before December 15, 2022; (b) The Tenant shall also pay the monthly rent in full by the 1st of each month from June 2021 to December 2022. If the Tenant fails to make any of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and the balance owing shall become payable with interest.
