What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had vacated the rental unit prior to the hearing date.

The ruling

The tenancy was terminated effective February 22, 2022. The tenants are ordered to pay $1,735.40 to the landlord, which includes rent arrears up to the termination date and compensation for use of the unit, plus $23.80 per day starting February 12, 2022 until the unit is vacated. If the tenants pay $2,656.00 on or before February 22, 2022, the eviction order will be void and the tenancy will continue.
