What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears. The Tenant had vacated the rental unit on April 30, 2020, prior to the hearing date.
The ruling
The tenancy between the Landlord and the Tenant is terminated as of April 30, 2020. The Tenant shall pay the Landlord $2,849.35, which includes rent arrears up to the move-out date, compensation, and the cost of filing the application, less the rent deposit and interest on the deposit. If the Tenant does not pay the full amount by October 4, 2020, the Tenant will start to owe interest at 2% annually on the outstanding balance.
