What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears.
The ruling
The tenancy is terminated effective October 15, 2021. The Tenant must pay the Landlord $4,226.56, which includes rent arrears, NSF cheque charges, and the application filing fee, less the rent deposit and interest owed. The Tenant must also pay $34.11 per day for use of the unit from September 30, 2021 until move-out. The Tenant can void the eviction order by paying $5,472.85 on or before September 30, 2021, or $6,510.22 on or before October 15, 2021.
