What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The Tenants failed to void the N4 Notice by paying the arrears. The Tenants have been struggling financially and have been making partial payments. The Landlord opposed a payment plan due to previous unpaid arrears and failed payment plans.
The ruling
The tenancy is terminated unless Tenants void the order by paying $5,808.66 by January 31, 2023, or $6,824.93 by February 5, 2023. If not voided, Tenants must vacate by February 5, 2023, and pay $3,943.16 plus $33.41 per day from January 6, 2023, until move-out. The eviction can be enforced starting February 6, 2023, if the unit is not vacated.
