What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. Tenant did not dispute the arrears but claimed non-payment was due to the conduct of the Landlord's superintendent. The Tenant's attempt to raise issues under section 87(2) of the Residential Tenancies Act was denied due to lack of proper disclosure.

The ruling

The tenancy was terminated effective February 17, 2022, when the Tenant vacated the unit. The Tenant is ordered to pay $2,434.71 to the Landlord, which includes rent arrears up to the move-out date and the cost of filing the application, minus the rent deposit and interest on the deposit.
