What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. Landlord also applied for an order to terminate the tenancy and evict Tenant because Landlord requires possession of the rental unit for the purpose of residential occupation.

The ruling

The tenancy is terminated effective December 29, 2018. The Tenant must pay the Landlord $2,093.28, which includes rent arrears up to the termination date, compensation up to the order date, and the cost of filing the application, minus the rent deposit and interest on the deposit. The Tenant must also pay $23.01 per day for compensation for use of the unit starting December 13, 2018 until the Tenant moves out. If the Tenant pays $5,117 on or before December 29, 2018, the eviction order will be void and the tenancy will continue.
