What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant was still in possession of the rental unit on the hearing date.
The ruling
The Tenant shall pay the Landlord $3,364, which includes $3,178 in rent arrears and $186 in application filing costs. The Tenant shall pay $100 per month towards the arrears starting September 15, 2022 up to and including June 15, 2025, and a final payment of $64 on or before July 15, 2025. The Tenant shall also pay the full rent on or before the 1st of each month from August 1, 2022 to August 1, 2025 or until all arrears are paid, whichever is sooner. If the Tenant fails to make any payment, the outstanding balance shall become immediately due and the Landlord may apply for an order terminating the tenancy and evicting the Tenant.
