What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord also claimed compensation for each day the Tenants remained in the unit after the termination date. The Tenants acknowledged late payments but requested relief from eviction, stating they could pay the rent when due and would pay the arrears.
The ruling
The Landlord and Tenant Board granted relief from eviction to the Tenants, subject to conditions. The Tenants must pay the monthly rent on or before the 1st day of each month for 12 consecutive months starting February 2023. They must also pay the outstanding rent arrears of $1,969.00 by February 15, 2023, and the application filing fee of $186.00 by February 12, 2023. If the Tenants fail to comply with these conditions, the Landlord may apply for an order terminating the tenancy and evicting the Tenants within 30 days of a breach.
