What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice of Termination, which the Tenant did not void by paying the arrears.
The ruling
The Landlord's application for eviction of the Tenant is denied on the condition that: 1) The Tenant shall pay $600.00 to the Landlord on or before the 1st of each month commencing on December 15, 2021, up to and including November 15, 2022. 2) The Tenant shall pay $107.00 to the Landlord on or before December 15, 2022. 3) The Tenant shall also pay the Landlord the rent for the months of December 2021 up to and including December 2022 in full, on or before the first day of each corresponding month. If the Tenant fails to make any of the payments in accordance with these conditions, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and for the payment of any new arrears of rent and NSF charges.
