What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. The tenants had not vacated the rental unit by the hearing date.
The ruling
The tenancy is terminated effective March 15, 2022. The Tenants must pay the Landlord $1,002.39, which includes rent arrears up to February 4, 2022 and the application filing fee, as well as $28.64 per day in compensation starting February 5, 2022 until they vacate the unit. The Tenants can void the eviction order by paying $1,928.00 on or before February 28, 2022 or $2,799.00 on or before March 15, 2022.
