What happened

Landlord applied to terminate tenancy and evict Tenant for failing to meet conditions specified in a previous order. Tenant filed a motion to set aside the eviction order. The Board denied the Tenant's motion due to continued non-payment and late payment of rent.

The ruling

The Landlord and Tenant Board denied the Tenant's motion to set aside the previous eviction order (TNL-33106-21). The Board found it would be unfair to grant the Tenant's motion due to continued non-payment and late payment of rent, including failure to pay May and June rent at all, and late payments for July and August. The stay on the eviction order was lifted immediately.
