What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenant did not void by paying the arrears. The tenant had not paid the total rent required from March 1, 2020 to April 30, 2021.

The ruling

The tenancy was terminated effective February 19, 2022. The tenant was ordered to pay $14,038.80 to the landlord, which includes rent arrears up to the termination date and the cost of filing the application. If the tenant pays $28,036 on or before February 19, 2022, the eviction order will be void and the tenancy will continue.
