What happened
Landlord Inira Properties Inc. and its director Rajeev Raveendran purchased a property in Hepworth, Ontario in December 2022. The previous owners, Codi and Steven Dickinson, had a tenant named Katie Hewitson living in the property. Hewitson refused to vacate the property after the sale, claiming an interest in the property. Inira and Raveendran filed an application seeking a declaration that they are the lawful owners and to obtain a writ of possession to remove Hewitson from the property.
The ruling
The court granted summary judgment in favor of the landlords, Inira Properties Inc. and Rajeev Raveendran. The court found that Inira is the lawful owner of the property and that the tenant, Katie Hewitson, has no legal interest in the property. The court issued a writ of possession to remove Hewitson from the property, but stayed the enforcement of the writ until July 12, 2024. The court also awarded the landlords $45,793.12 in damages and $36,711.16 in costs.
