What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to persistent late payment of rent. The Landlord alleged that the Tenants failed to pay rent in full on the first of the month on 10 occasions from April 2020 to March 2021.

The ruling

The Landlord's application for eviction of the Tenants is denied on the condition that the Tenants shall pay the full monthly rent on or before the first day of each month, commencing September 1, 2021 and for 11 months thereafter up to and including August 1, 2022. If the Tenants fail to comply with the conditions, the Landlord may apply for an order terminating the tenancy and evicting the Tenants.
