What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears.

The ruling

The Landlord's application for eviction of the Tenant is denied on the condition that the amount of $1,689.00, which represents the arrears of rent ($1,503.00) and costs ($186.00) outstanding for the period ending March 30, 2021, is paid no later than April 30, 2021. The Tenant will also pay the rent owing for April 1, 2021 to April 30, 2021 on time and in full. If the Tenant fails to make any of the payments, the Landlord may apply for an order terminating the tenancy and evicting the Tenant, and for the payment of any new arrears of rent and NSF charges not already ordered.
