What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent as per the previous LTB order.

The ruling

The tenancy is terminated, and the Tenant must move out of the rental unit on or before February 20, 2023. If the unit is not vacated by that date, the Landlord may file the order with the Court Enforcement Office (Sheriff) for enforcement. The Tenant shall pay the Landlord $9,827.04 (less any payments made after the application was filed) for rent owing up to February 9, 2023, and the cost of filing the application, less the rent deposit and interest owed on the rent deposit. The Tenant shall also pay the Landlord $32.05 per day for compensation for the use of the unit starting February 10, 2023 until the Tenant moves out.
