What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The Landlord also applied for an order to terminate the tenancy and evict the Tenant because the Tenant has been persistently late in paying the rent.

The ruling

The Landlord's L2 application is dismissed. Unless the Tenant voids the order by paying $6,241.00 on or before September 20, 2021, the tenancy between the Landlord and the Tenant is terminated. The Tenant must move out of the rental unit on or before September 20, 2021. The Tenant shall pay to the Landlord $3,446.02, which represents the amount of rent owing and compensation up to September 9, 2021 and the total charges related to NSF cheques, less the rent deposit and interest the Landlord owes on the rent deposit. The Tenant shall also pay to the Landlord $49.32 per day for compensation for the use of the unit starting September 10, 2021 to the date the Tenant moves out of the unit. The Tenant shall also pay to the Landlord $201.00 for the cost of filing the application.
