What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid N4 Notice, which the Tenants did not void by paying the arrears. The Tenants had not paid rent since February 2020.
The ruling
The tenancy is terminated effective March 31, 2022. The Tenants must pay the Landlords $35,186, which includes rent arrears up to March 31, 2022, compensation for use of the unit after that date, and the application filing fee, less the rent deposit and interest. If the Tenants pay $58,836 by March 31, 2022, the eviction order will be void and the tenancy can continue.
