What happened

Tenant applied for an order determining that the Landlord collected or retained money illegally. The Tenant had entered into a lease agreement with the Landlord for a room in the Landlord's rented house, and paid a deposit. The Tenant vacated the rental unit, and the Landlord did not return the damage deposit.

The ruling

The Board found that the Landlord was not a landlord as defined in the Residential Tenancies Act, 2006, and therefore the Board had no jurisdiction over this matter. The Tenant's application was dismissed.
