What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears. The Tenant was still in possession of the rental unit at the time of the hearing and could not offer a viable repayment plan for the arrears.
The ruling
The tenancy is terminated unless the Tenant voids the order by paying $20,094.00 on or before September 30, 2022. If the Tenant does not void the order, they must move out by September 30, 2022, and pay the Landlord $15,399.95 plus $72.72 per day from September 1, 2022, until they move out. The Tenant may make a motion to void the order if they pay the full amount owing plus any additional rent that became due after September 30, 2022, but before the Sheriff enforces the eviction.
