What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the Tenant did not void by paying the arrears.

The ruling

The Landlord's application to terminate the tenancy and evict the Tenant is denied, subject to the Tenant making monthly payments of $497 towards the arrears from March 2021 to August 2022, and paying the remaining $321.97 by September 1, 2022. The Tenant must also pay the February 2021 rent by February 28, 2021 and the lawful monthly rent on time going forward.
