What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent. The Landlord also claimed NSF cheque charges and related administration charges. The Tenant had not paid the total rent for the period from March 1, 2021 to January 31, 2022.

The ruling

The Landlord's application for eviction is denied on the condition that the Tenant adheres to a payment plan. The Tenant must pay $7,468.80 in arrears, NSF charges, and costs, through monthly installments from February 1, 2022 to October 1, 2022. The Tenant must also pay regular rent during this period. If the Tenant fails to make any payments, the Landlord may apply for eviction within 30 days of the breach.
