What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to the Tenants seriously impairing the safety of any person and wilfully causing undue damage to the premises. The Tenants caused a fire in the rental unit on September 9, 2022, which resulted in the unit being completely destroyed.

The ruling

The tenancy is terminated as of September 9, 2022, the date the Tenants caused the fire in the rental unit. The Tenants are ordered to pay the Landlord $35,000 for the reasonable costs of repairing the damage and/or replacing the damaged property, as well as $186 for the cost of filing the application. If the Tenants do not pay the full amount by January 21, 2023, they will start to owe interest at 5% annually on the outstanding balance.
