What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice). However, the Tenant had paid all arrears and compensation owed to the Landlord, as well as the filing fee, before the hearing. The Tenant had also vacated the rental unit prior to the hearing.

The ruling

The original order was cancelled and replaced with a new order, as there was a serious error in the previous order. The Landlord's L1 application was discontinued based on the agreed facts.
