What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. The Landlord served a valid N4 Notice, which the Tenants did not void by paying the arrears. The Tenants were still in possession of the rental unit at the time of the hearing but had made substantial payments towards the arrears.

The ruling

The tenancy will be terminated unless the Tenants void the order by paying $343.01 by February 28, 2023, or $2,031.24 by March 31, 2023. If payment is not made, the Tenants must vacate by March 31, 2023. The Landlord owes the Tenants $2,356.26 from the rent deposit and interest, but can deduct $55.50 per day for use of the unit from February 14, 2023, until the Tenants move out.
