What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent. Tenant 2 vacated the rental unit on May 23, 2022, and was removed as a party to the application by mutual agreement. Tenant 1 vacated the rental unit on September 30, 2022. The Landlord served a valid N4 Notice, which the Tenant did not void by paying the arrears.
The ruling
The tenancy was terminated effective September 30, 2022, the date Tenant 1 vacated the rental unit. Tenant 1 is ordered to pay $6,702.59 to the Landlord, which includes rent arrears up to the move-out date and the cost of filing the application, minus the rent deposit and interest on the deposit. If the Tenant does not pay by April 28, 2023, interest will start accruing at 5% annually on the outstanding balance.
