What happened

Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent and persistent late payment of rent. The Landlords served valid N4 and N8 notices, but the N8 notice was found to be invalid as the termination date was not the last day of a rental period.

The ruling

The tenancy is terminated effective May 15, 2021. The Tenants must pay the Landlords $19,743.62 in rent arrears and compensation, plus $201 in application fees, and $65.75 per day in compensation starting May 5, 2021 until they vacate the unit. The Tenants can void the eviction order by paying $22,701 on or before May 14, 2021, or $24,701 on or before May 15, 2021.
