What happened
Landlord applied for an order to terminate the tenancy and evict Tenant due to persistent late payment of rent. The Landlord served an N8 notice on July 1, 2021. The Tenant failed to pay rent in full by the first of the month ten times in twelve months.
The ruling
The Landlord's application for eviction is denied on the condition that the Tenant pays the full monthly rent on or before the first day of each month for 12 months, starting February 1, 2022. If the Tenant fails to comply, the Landlord may apply for termination within 30 days of the breach. The Tenant must also pay $186.00 for the application filing cost.
